Laura Prepon and her estranged husband, Ben Foster, are locked in a heated custody battle, with both sides filing serious allegations. According to court documents, Prepon accused Foster of having issues with alcohol and failing to prioritize their children. Foster, in turn, denied the claims and alleged Prepon has exercised “total control” over their children since their separation.

Foster, 44, argued through his lawyer, Rose Palermo, that he has not been allowed meaningful parenting time, including overnight visits. He also denied having a longstanding drinking problem, stating he has been a social drinker and has never endangered their children. In response, his legal team criticized Prepon for using the children as “pawns” and cited her public promotion of alcohol on social media.

Prepon’s legal team, led by Larry Hayes, submitted witness affidavits supporting her claims. Laura Vogel, an employee of seven years, stated that Prepon has been the primary caretaker, while Foster showed minimal involvement. She alleged instances where Foster drank alcohol around the children and added alcohol to his coffee. Another affidavit from the couple’s nanny, Emily Neikman, described Foster’s sporadic presence and concerns about his drinking, claiming to have found whiskey in coffee cups left in the children’s rooms.

Foster disputed these allegations, including a specific incident where Prepon claimed he was drunk outside their home. He stated he had just returned from filming and was not intoxicated. Instead, he accused Prepon of extreme mood swings.

The couple, who married in May 2018, share two children. Foster filed for divorce in September, listing the date of separation as September 9. Prepon has requested that Foster refrain from drinking 12 hours before or during his parenting time. A judge has yet to rule on the matter.
